IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO PIZZANA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

The limitations of liability set forth in this section shall apply regardless of the legal theory under which liability is sought, including contract, tort, strict liability, or otherwise, and shall survive termination of these Terms.

Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.


9. Disclaimer of Warranties

THE SERVICES, INCLUDING THE SITE AND ALL CONTENT, FEATURES, AND FUNCTIONALITY THEREOF, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.   • WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, TIMELINESS, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICES;
  • WARRANTIES THAT ANY DEFECTS IN THE SERVICES WILL BE CORRECTED.

The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of the dispute resolution and arbitration provisions set forth in Section 12 of these Terms.

To the extent applicable, these Terms are also subject to relevant provisions of the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) governing consumer protection and unfair or deceptive trade practices. 12. Dispute Resolution and Arbitration

12.1 Informal Resolution

We will make good-faith efforts to resolve the dispute within thirty (30) days of receipt of your notice.

12.2 Binding Arbitration

If a dispute cannot be resolved informally within thirty (30) days, you and Pizzana agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or your use of the Services (collectively, "Disputes"), shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, except as modified herein.

The arbitration shall be conducted in the English language and, unless otherwise agreed by the parties, shall take place in the United States, in the state where Pizzana operates. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

12.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PIZZANA EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. You may only bring claims against Pizzana in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

12.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.

12.5 Arbitration Costs

The allocation of arbitration fees and costs shall be governed by the AAA's Consumer Arbitration Rules. If you are a consumer and the value of your claim does not exceed $10,000, Pizzana will pay all AAA filing, administrative, and arbitrator fees, unless the arbitrator finds your claim to be frivolous or brought in bad faith.


13. Term and Termination

These Terms of Service are effective from the date you first access or use our Services and shall remain in full force and effect until terminated in accordance with the provisions herein.

You may terminate your account and your use of the Services at any time by contacting us at [email protected] and requesting account deletion. Termination of your account does not relieve you of any obligations incurred prior to termination, including payment for any outstanding orders.
